Summary

The Town of North Attleborough seeks proposals from qualified organizations to lease space in the Town owned building located at 451 Elm Street, North Attleborough (the “Property”), for the purpose of operating a day care center or similar activity. The space available for lease contains approximately 12,122 square feet and consists of portions of the first floor of the building (the “Building”) at the Property (as more specifically described below, the “Leased Area”). The lease of the Leased Area is subject to the Uniform Procurement Act, G.L. c. 30B and the provisions of G.L. c. 30B, Section 16, are incorporated herein by reference. The designated organization will be required to submit a disclosure of beneficial interest in order to comply with G.L. c. 7C, Section 38. The Town of North Attleborough is seeking an organization to operate a day care center or similar activity in the Leased Area. The entity shall staff the facility with professional staff, which may be complemented by volunteer staff. Staff members and volunteers shall not be considered as employees of the Town of North Attleborough. The Town intends to lease the Leased Area to an organization for an initial term of ten (10) years, with the possibility of an extension, subject to applicable procurement law. The organization will be responsible for all operating costs of the Leased Area, including but not limited to, staffing and janitorial services at the Leased Area. The Town of North Attleborough will be responsible for the maintenance of the structure of the Building, the Building systems, and the exterior grounds. A lease agreement will be negotiated between the Town of North Attleborough and the proposer with the proposal considered most advantageous to the Town of North Attleborough as determined by the Town Manager

The Leased Area is a portion of the building located at 451 Elm Street. The Leased Area contains approximately 12,122 square feet and is substantially shown on the sketch plan attached hereto as Exhibit B and incorporated herein. The Property includes parking areas, and the tenant will have the exclusive use of twenty (20) spaces in the Annex Parking Lot and three (3) drop-off/pick-up spaces at the northwest corner of the Building. The tenant will have the right to exclusive use of the Leased Area, and the right to use, in common with others, the hallways, corridors and lavatories in the Building and the walkways and driveways on the Property (the “Premises”). The Town of North Attleborough is providing some of the information suitable to making an informed decision on the suitability of the Premises. The Town, however, makes no representations or warranties, either express or implied, that the Premises comply with the zoning bylaws of the Town of North Attleborough, that the Premises can be used for any particular use or purpose, or about the condition of the Premises. Proposers are expected to undertake an independent review and analysis of zoning, physical and environmental conditions, required approvals, and other development and legal considerations applicable to the Premises. Acceptance of the proposal by the Town does not constitute permit approval. No special consideration shall be given, and fees will not be waived. The successful proposer will be required to pay monthly rent in the minimum amount of $15,400, which sum shall increase by 2.5% each year during the term of the lease over the prior year’s rent. Selected proposer may negotiate terms of rent with the Town to cover potential costs required to bring Premises into compliance with building code. The tenant shall be responsible to pay for all real estate taxes and other impositions assessed to the Premises, provided, however, the rent payable by the tenant shall be reduced by the amount of said real estate taxes and other impositions. The tenant shall pay, as additional rent, all charges for its telephone, cable, internet, and other services provided to the Leased Area. The Town’s operating costs consist of all costs associated with electricity, water, sewer, reasonable heating and cooling, refuse collection and disposal, property insurance and maintenance of the common areas, provided that the cost of any services provided solely to the tenant of the Leased Area shall be billed solely to the tenant.
